VIDEO: Officer Cleared in Fatal OIS Trial

November 5, 2015

Officer Lisa Mearkle was found not guilty in the shooting death of an unarmed man.

In February, Officer Mearkle initiated a traffic stop for an expired inspection sticker.  The driver, David Kassick fled and Officer Mearkle pursued him to his sister’s house.  Officer Mearkle pursued Kassick on foot when he ran to the backyard.  At this point, a conflict ensues.

The Dauphin County Chief Deputy District Attorney argued that Officer Mearkle acted unreasonably when she fired two fatal gunshots into Kassick’s back as he was lying on the ground.

The video shows and the defense argued that the conflict had escalated to the point where it was reasonable for Mearkle to conclude that Kassick was reaching for a weapon.

Officer Mearkle plans on returning to work now that she has been cleared of all charges.
